Takings

Government decision-makers often face the daunting task of determining whether regulatory actions will create unconstitutional “takings” of private property. In recent years, private plaintiffs have frequently brought constitutional claims against ordinances, regulations, or other actions designed to protect public interests. Such claims are particularly common where government acts to protect or manage natural resources. Rossmann and Moore assists government clients in drafting ordinances and regulations that achieve their protective purposes yet minimize vulnerability to takings claims. Rossmann and Moore also defends clients against takings challenges. Sample cases include its successful defense in Allegretti v. County of Imperial, which a leading commentator recently described as the most important takings case of 2006.
